A Durable Power of Attorney (POA) appoints an Attorney-in-Fact to act in the place of someone who later becomes unable make their own medical or financial decisions. They are a form of advanced planning that must be put into place while a person still has capacity to make their own decisions. This allows for a person to name whom they would prefer to make medical or financial decisions on their behalf instead of having a court make the decision for them, and is an excellent less restrictive alternative to guardianship.
Having powers of attorney prepared by an attorney well in advance of need is highly recommended.
